Booking Conditions

Preamble

These General Terms and Conditions of Sale and Provision of Services, hereinafter referred to as the «General Terms and Conditions», are offered by:

HOTEL APOLLO, a simplified joint-stock company (*société par actions simplifiée*) with a share capital of 8,000 euros, registered in the Trade and Companies Register of Paris under number 442 364 014, having its registered office located at 11 rue de Dunkerque, 75010 Paris, with SIRET number 442 364 014 00039 and intra-community VAT number FR37 442 364 014, represented by its legal representative(s) in office,

operating the hotel business traded under the name «Hôtel Flanelles Paris», located at 11 rue de Dunkerque, 75010 Paris, hereinafter the ’Establishment«.

 

These Terms and Conditions govern the procedures for booking, payment, guarantees, modification, cancellation and performance of the accommodation services offered by the Establishment, as well as the services strictly ancillary to the booking and the room stay when they are expressly included in the Booking Confirmation.

They apply equally to Consumer Customers and Business Customers, subject to the specific provisions applicable to each of these categories.

Every Booking implies that the Customer has read these Terms and Conditions and accepts them in their entirety, without reservation, under the conditions specified below.

1. Definitions

For the purposes of these General Terms and Conditions, the following terms have the meaning defined below:

«Consumer Customer any natural person of legal age with legal capacity acting for purposes which are outside their trade, business, craft or profession.

«Professional Client»: any natural or legal person acting for purposes relating to their trade, business, craft, liberal profession, agricultural activity or, more generally, professional activity.

«Client: interchangeably the Consumer Customer and the Professional Customer where these General Conditions apply to them in an identical manner.

«Establishment: the Hôtel Flanelles Paris, operated by the company HOTEL APOLLO at 11 rue de Dunkerque, 75010 Paris.

«Terms and Conditions these General Terms and Conditions of Sale and Provision of Services applicable to the Services offered by the Establishment.

«Special Conditions the specific conditions agreed between the Establishment and the Client for a given Reservation, in particular those appearing in an offer, a quote, a Reservation Confirmation or the conditions of the Reserved Rate.

«Contract the contractual whole formed by these General Terms and Conditions, the Special Terms and Conditions and any document accepted by the Parties in connection with the Booking.

«Booking any request for Accommodation Services made by the Customer and accepted by the Establishment.

«Booking Confirmation the document sent to the Customer confirming the essential characteristics, price and conditions of their Booking.

«Group Booking Any reservation comprising eight rooms or more for the same period, the same customer, the same group of beneficiaries or the same operation.

«Services: the accommodation services booked with the Establishment and, where applicable, the strictly ancillary services expressly mentioned in the Booking Confirmation.

«Member Rate: the price applicable to the Services chosen by the Client, as well as the guarantee, payment, modification and cancellation conditions associated therewith.

«Deposit any sum paid by the Client prior to the execution of the Services and deducted from the total price due, when a deposit is provided for by the Special Conditions.

«Non-appearance or no-show: the absence of the Client or the beneficiary on the scheduled date of arrival, without prior cancellation in accordance with the conditions applicable to the Reserved Rate.

2. Purpose and scope

2.1 Purpose

The purpose of these General Terms and Conditions is to define the conditions for booking, guarantee, payment and provision of the accommodation services offered by the Establishment.

They apply to bookings made directly with the Establishment and to accommodation services expressly confirmed to the Client.

Bookings of eight rooms or more are considered group reservations.

 

2.2 Acceptance of the General Terms and Conditions

Any booking implies that the Client acknowledges having read these General Terms and Conditions prior to the conclusion of the Contract and accepts them fully and without reserve.

The Customer declares that they have received all the information necessary for booking the Services offered by the Establishment and have verified that these meet their requirements.

 

2.3 Special Conditions

Certain offers, Reserved Rates or Bookings may be subject to Special Conditions agreed between the Establishment and the Client.

In the event of any contradiction between these General Terms and Conditions and the Specific Terms and Conditions, the latter shall prevail for the Booking concerned.

 

2.4 Bookings made through third parties

These Terms and Conditions apply to Bookings made directly with the Establishment, in particular by telephone, email, at reception or via the Website.

Bookings made through a travel agency, an online booking platform, a tour operator or any other intermediary also remain subject to the specific contractual terms and conditions of that intermediary. In the event of a contradiction regarding payment, modification or cancellation terms, the conditions communicated by the intermediary at the time of the Booking shall prevail for the sale made by them.

 

2.5 Availability of the Terms and Conditions

These General Conditions can be viewed on the Establishment's Website and can be provided upon simple request.

2.6 Modification of Terms and Conditions

The Establishment reserves the right to modify these General Terms and Conditions at any time. The applicable General Terms and Conditions are those in force on the date of the Booking. Subsequent modifications shall not apply to Contracts already concluded, unless otherwise required by mandatory law or by express agreement of the Parties.

3. Pre-contractual information

In accordance with the provisions of the Consumer Code, the Customer acknowledges having received, prior to any Booking and before the conclusion of the Contract, in a clear and comprehensible manner, these General Terms and Conditions as well as the following information:

  • the essential characteristics of the Services offered by the Establishment; ;
  • the price of the Services, applicable taxes and, where applicable, any additional charges; ;
  • the guarantee, payment, modification and cancellation conditions applicable to the Reserved Rate; ;
  • the date or period of performance of the Services; ;
  • information relating to the identity, contact details and activity of the Establishment; ;
  • the payment methods accepted by the Establishment; ;
  • the absence of a right of withdrawal for accommodation services to be provided on a specific date or at a specific frequency; ;
  • the complaints procedure.

The Client acknowledges having obtained all the information necessary for their decision to book the Services offered.

4. Booking

4.1 Booking conditions

Bookings can be made directly with the Establishment:

  • directly from the establishment's reception desk, 11 rue de Dunkerque, 75010 Paris.

All reservation requests are subject to the establishment's availability.

 

4.2 Formation of the Contract

The booking becomes final upon:

  • the communication by the Customer of the information necessary for the processing of their request; ;
  • the acceptance of these General Terms and Conditions and any Specific Terms and Conditions; ;
  • the provision of a valid bank card as a guarantee or the payment required by the Reserved Rate; ;
  • the sending by the Establishment or its booking system of a Booking Confirmation by email or by any other durable medium.

Failing fulfilment of a required condition, the Institution is not obliged to maintain the availability of the requested Services.

 

4.3 Group Bookings

Any request for eight rooms or more for the same period, the same Client, the same group of beneficiaries or the same operation is considered a Group Booking.

 

4.4 Accuracy of the information provided

The Customer is solely responsible for the accuracy of the information provided at the time of booking. In particular, they are responsible for verifying the dates of the stay, the number of rooms and occupants, the identity of the beneficiaries, the email address, telephone contact details and billing information.

The Establishment cannot be held liable for the consequences resulting from incomplete, inaccurate or erroneous information provided by the Client.

 

4.5 Special requests

Any special requests, particularly regarding bed configuration, accessibility, early arrival, late departure or welcoming a pet, are met subject to availability, feasibility and, where applicable, the payment of a supplement. They only become contractual after written confirmation from the Establishment.

 

4.6 Refusal or cancellation of a Booking by the Establishment

The Establishment reserves the right to refuse or cancel any Reservation for a legitimate reason, in particular in the event of unavailability, payment default or incident, invalid bank card, fraud or attempted fraud, failure to comply with these General Terms and Conditions, or when the request is likely to undermine the security, peace and quiet or proper operation of the Establishment.

Where cancellation is attributable to the Establishment and does not result from an act by the Client or a case of force majeure, the sums paid in respect of unperformed Services shall be refunded, without prejudice to the mandatory rights of the Client.

5. Prices

The applicable rates are those in force on the day of the Booking. They are quoted in euros, all taxes included, excluding tourist tax and any supplementary charges, unless stated otherwise.

The tourist tax, the amount of which is set by the competent authorities, is not included in the displayed price, unless expressly stated otherwise. It is payable by the Customer and must be settled directly with the Establishment in accordance with the terms applicable on the day of the stay.

Rates are non-commissionable, unless a written commercial agreement has been concluded with the Establishment.

 

5.1 Taxes

The rates include value added tax at the rate in force on the day of the Booking. Any change in the statutory VAT rate, tourist tax or any other legally applicable tax shall be reflected from the date it comes into force, including where the Booking has been previously confirmed, within the limits permitted by regulations.

 

5.2 Price trends

Prices are subject to change at any time depending on the booking period, the dates of the stay, the occupancy level, demand and the Establishment's pricing policy. However, the Rate Reserved and confirmed to the Customer shall remain applicable to their Booking, subject to legally imposed taxes and contributions.

 

5.3 Promotional offers and prices

The Establishment may offer promotional deals, preferential rates, early bird offers or special offers, valid during their sales period, subject to availability and in accordance with the conditions displayed at the time of booking.

Unless otherwise stated, these offers cannot be used in conjunction with each other or with any other reduction or benefit.

 

5.4 Flexible Tariff

The Flexible Rate allows the Customer to cancel their Booking free of charge until 12:00, local Paris time, on the scheduled day of arrival.

After this period, in the event of a late cancellation, the first night of the stay will be charged. In the event of a no-show, the first night will also be charged.

Payment for the stay is due upon arrival, unless otherwise specified in the Booking Confirmation. The booking must be guaranteed by a valid bank card and may be subject to a pre-authorisation in accordance with Article 6.

 

5.5 Promotional Tariffs and Early Booking

Promotional rates, including offers marketed under names such as «Early Booking», are subject to the same guarantee, payment, modification and cancellation conditions as the Flexible Rate, barring Special Conditions expressly displayed and accepted at the time of Booking.

In the absence of contrary Special Conditions, cancellation is therefore free of charge until 12:00 on the day of arrival; after this time, or in the event of a No-show, the first night is charged.

 

5.6 Non-Cancellable and Non-Refundable (NANR) Rate

The Non-Cancellable and Non-Refundable Rate is non-amendable, non-cancellable and non-refundable.

The total cost of the stay is payable in advance by credit card at the time of booking. In the event of cancellation, amendment, no-show or a stay not taken, 100 % of the total cost of the stay shall be retained by the Establishment, with no possibility of a refund, subject to mandatory legal provisions.

The bank card used for payment must be presented at reception upon the Customer's arrival. The Establishment may also request identification to prevent any fraudulent use.

City tax is not included and is collected directly by the property in accordance with the terms and conditions applicable on the day of the stay.

6. Booking guarantee, payment methods and bank pre-authorisation

6.1 Reservation guarantee

Every reservation must be guaranteed by a valid bank card, unless payment has been made in full in advance or contrary Special Conditions apply. The card must remain valid until the scheduled departure date.

If the bank guarantee is invalid or if the pre-authorisation is declined, the Establishment may ask the Client to provide a new guarantee within a reasonable timeframe. Failing regularisation, the Reservation may be cancelled after informing the Client.

 

6.2 Card pre-authorisation

As part of the reservation check, the Establishment may carry out a bank pre-authorisation between seven days prior to arrival (D-7) and the day of arrival (D0). This operation is intended to verify the validity of the bank card and the availability of the funds required to guarantee the Reservation.

The pre-authorisation does not constitute a final debit. However, it may temporarily reduce the available amount on the Client's account or their payment limit. The timeframe for releasing the funds depends on the Client's bank and is beyond the control of the Institution.

 

6.3 Accepted payment methods

Subject to the Specific Conditions applicable to the Reserved Rate, the Establishment accepts the following payment methods:

  • Visa, Mastercard and American Express bank cards; ;
  • cash, within the limits laid down by French regulations; ;
  • cheques, solely following prior express validation by the Establishment or its accounts department.

Unless otherwise specified in the terms of the Reserved Rate, payment for the stay is due upon arrival. Any remaining additional services, supplements and taxes must be paid for no later than upon departure.

7. Modification, cancellation, no-show and shortened stay

7.1 Principle

Modification, cancellation, refund and invoicing conditions depend on the Rate Reserved and, where applicable, the Special Conditions. The Customer is advised to check these before confirming their Reservation.

 

7.2 Absence of right of cancellation

In accordance with Article L. 221-28 of the Consumer Code, the Customer does not benefit from the right of withdrawal provided for distance contracts when accommodation services are to be provided on a specific date or at a specified periodicity.

 

7.3 Modification

Any request for modification must be sent to the Establishment as soon as possible. It is subject to availability, the conditions of the Reserved Rate and, where applicable, a price change. A modification is only confirmed upon written confirmation from the Establishment.

The NANR tariff cannot be subject to any modification, barring an express and exceptional goodwill gesture by the Establishment, which shall not constitute a right for the Customer.

 

7.4 Cancellation and No-show

For Flexible, promotional, and Early Booking rates subject to the Flexible Rate conditions, cancellation is free of charge until 12:00 on the day of arrival. After this time, or in the event of a No-show, the first night will be charged.

For the NANR rate, any cancellation or no-show will result in 100 % of the amount paid for the stay at the time of booking being retained.

 

7.5 Early departure or shortened stay

For Flexible, promotional and Advance Purchase rates subject to the Flexible Rate conditions, any reduction in stay notified to the Establishment before 12:00 on the day in question is free of charge for the cancelled night. If the request is made after 12:00, the night in question will be charged.

For the NANR rate, no refund is due in the event of early departure or shortened stay.

8. Arrival, stay and departure

8.1 Timetable

Rooms are available from 14:00 on the day of arrival and must be vacated by 12:00 at the latest on the day of departure.

Any early arrival or late departure is subject to availability, confirmation by the Establishment and, where applicable, the payment of a supplement. In the event of unauthorised late check-out, compensation may be charged in accordance with the rates displayed or communicated by the Establishment.

 

8.2 Identification and arrival formalities

On arrival, the Establishment may ask the Client and the occupants to present a valid identity document and to complete the applicable legal formalities. The Client must also present, when required, the bank card used to guarantee or pay for the Reservation.

 

8.3 Room occupancy

A room may only be occupied by the number of people indicated in the Reservation Confirmation and up to its authorised capacity. Any additional person must be declared and accepted by the Establishment; this may result in a supplement or a refusal of accommodation if the maximum capacity is exceeded.

The Client remains responsible for the persons for whom they have booked as well as for their actions within the Establishment.

 

8.4 Minors

Minors must be accompanied by and remain under the responsibility of an adult for the duration of the stay, barring prior written agreement from the Establishment and presentation of the required authorisations.

 

8.5 Behaviour, safety and internal regulations

The Customer agrees to use the premises and equipment in a reasonable manner, to respect the peace and quiet of other customers, safety rules, legal prohibitions and the Establishment's internal regulations.

Any behaviour contrary to public decency, public order, safety rules or the proper functioning of the Establishment, as well as any damage, serious disturbance, threat or violence, may result in the immediate termination of the stay, without compensation or refund, without prejudice to the invoicing for damages and any legal action the Establishment may take.

 

8.6 Personal effects and luggage

The Customer is advised not to leave valuables unattended and to use, when available, the security device provided in the room or at reception. Lost property is handled in accordance with the Establishment's regulations and procedures.

9. Liability and force majeure

9.1 Client Liability

The Customer is solely responsible for the choice of the Services booked and their suitability for their needs. They are responsible for any material or immaterial damage caused by themselves, their companions, their guests or any person under their responsibility.

Restoration, repair or replacement costs resulting from damage or loss attributable to the Client may be charged to them, based on the costs actually incurred or reasonably estimated by the Establishment.

 

9.2 Establishment Liability

The Establishment shall deploy the reasonable means necessary for the proper performance of the booked Services. Its liability may not be incurred in the event of non-performance or improper performance resulting from an act attributable to the Client, a third party unrelated to the provision of the Services, an event of force majeure or any event reasonably beyond its control.

In any event, the Institution's liability remains governed by the applicable legal and regulatory provisions, which these General Conditions may not derogate from.

 

9.3 Deposited items and hotel liability

The Establishment's liability regarding clothing, luggage, items and belongings brought by the Client is governed by Articles 1952 et seq. of the Civil Code. The Client must report any theft, loss or damage without delay and take all necessary measures to preserve their rights.

 

9.4 Force majeure

Neither Party shall be held liable for any failure resulting from an event of force majeure within the meaning of Article 1218 of the Civil Code and French case law. The Party concerned shall inform the other Party as soon as possible and take reasonable measures to limit the consequences of the event.

10. Personal data protection

As part of the management of bookings, customer reception, payments, invoicing, customer relationship management and compliance with its legal obligations, the Establishment collects and processes personal data concerning the Customer and the beneficiaries of the stay.

These processing operations are carried out in accordance with Regulation (EU) 2016/679 of 27 April 2016, known as the GDPR, and the amended Act No. 78-17 of 6 January 1978. Depending on the case, they are based on the performance of the Contract, compliance with a legal obligation, the legitimate interest of the Establishment or the consent of the data subject.

Data is accessible to authorised staff of the Establishment and, within the limits of their duties, to its technical, booking, payment, IT hosting or customer service providers. They are kept for the periods necessary for the purposes pursued and the applicable legal obligations.

Any data subject has, under the conditions provided for by the regulations, rights of access, rectification, erasure, objection, restriction of processing and portability, as well as the right to withdraw their consent at any time when the processing is based thereon.

These rights may be exercised by writing to bonjour@flanellesparis.fr or to HOTEL APOLLO – Hôtel Flanelles Paris, 11 rue de Dunkerque, 75010 Paris, specifying the subject of the request and providing, where necessary, information to verify the identity of the applicant.

The data subject may also lodge a complaint with the Commission nationale de l’informatique et des libertés (CNIL). Detailed information on data processing is set out in the privacy policy available on the Website.

11. Complaints

Any complaint relating to a Booking or a stay must be sent as soon as possible to the Establishment, accompanied by the evidence enabling it to be processed, to the following contact details:

The Parties shall endeavour to seek an amicable solution before taking any other step.

12. Governing law and dispute resolution

These Terms and Conditions are governed by and construed in accordance with French law.

In the event of any dispute relating to their interpretation, validity, performance or termination, the Parties shall endeavour to seek an amicable solution.

Failing an amicable settlement, any dispute shall be brought before the competent courts under the conditions provided for by the applicable legal provisions. These provisions do not deprive the Consumer Customer of the mandatory rights recognised under law, in particular the protective rules regarding territorial jurisdiction.

13. Final provisions

If any provision of these Terms and Conditions is declared null, illegal or unenforceable by a final decision, the remaining provisions shall remain in full force and effect.

Failure by the Institution to assert any of the provisions of these General Terms and Conditions at any time shall not be construed as a waiver of the right to assert them at a later date.

These General Conditions are drawn up in the French language. In the event of translation into one or more other languages, only the French version shall be deemed authentic in the event of a discrepancy in interpretation.

The applicable version is the one in force on the date of the Booking. These General Terms and Conditions cancel and replace any prior version as from their date of entry into force.
